Please note that as of February 1, 2009 the State of New York has amended section 380 of its General Business Law.

• New York employers must provide Article 23-A to their applicants that are subject to a criminal background check. Employers must give this document to applicants before they order the criminal search from a background screening company and when they receive a background screening report that reflects a criminal record.
• New York employers must also post a copy of Article 23-A in a conspicuous place.
